The client was granted leave to remain in the UK under the five years partner route to settlement. Following this, she submitted her on-line application for Indefinite Leave to Remain in the UK. The application was made at a time when our client had extant and valid leave to remain in the UK as a spouse.
Since her entry in the UK, the client had developed her family life with her husband, and they were expecting their first child together. The client was unable to timely book her Life in the UK Test, as a result of the medical check-ups she had to attend in relation to her pregnancy. In addition, in light of the spread of COVID-19 the client’s Life in the UK Test was again postponed and she was unable to obtain her certificate showing life in the UK test at the time of application.
Our expert solicitors were able to persuade the Home Office that discretion should be applied to her case. The client received a positive decision immediately after the test centres reopened, and she was able to acquire the certificate.
