Clear advice and a practical plan, from the first letter to the final judgment.

We represent you with a proactive and forward-thinking mindset.

Disputes Are Stressful. Resolving Them Doesn’t Have to Be.

A dispute rarely arrives at a convenient time. It might be a customer who won’t pay or a builder who has left the job half finished. Maybe it’s a tenant who has stopped paying rent or a business partner you no longer trust. Whatever it is, it’s hard to think about anything else.

Then there’s the admin and costs. Miss a deadline or skip a step the court expects, and you can lose a strong claim or end up paying the other side’s costs. Good advice early on makes all of this easier to manage.

Osbourne Pinner’s local team of litigation solicitors in Wimbledon is here to help. We can show you where you stand and try to settle the matter without going to court. We’ll also take it all the way to trial if we need to.

For a free 30-minute video consultation with our Wimbledon litigation solicitors, email [email protected], call 0203 983 5080 or use the form. From unpaid invoices to boardroom disputes, we act for businesses and individuals at every stage.

What Happens in a Typical Dispute?

Business team discussing a commercial litigation dispute

Whether it’s an unpaid invoice, a building job gone wrong or a falling-out between directors, knowing what’s coming makes the process less daunting. Most disputes follow the same basic steps, from first letter to final judgment.

It usually starts with a letter before claim. This sets out what went wrong and what you want, and gives the other side time to reply. It’s normally 14 days or 30 days for most debt claims. The court expects both sides to share key documents and consider settling before anyone issues a claim. A clear, well-evidenced letter often shapes how the rest of the dispute plays out.

If that doesn’t work, the claim is issued at court and allocated to a track based on its value. Most claims up to £10,000 go to the small claims track. Up to £25,000 goes to the fast track and up to £100,000 to the intermediate track. Larger or more complex cases go to the multi-track. Lots of cases settle along the way, but if yours doesn’t, the court decides at trial.

Winning a judgment isn’t always the end. If the other side still doesn’t pay, we can help you enforce the judgment through enforcement agents and charging orders.

What Does Litigation Cost?

The court charges a fee to start a money claim, based on how much you’re claiming. It ranges from £35 for claims up to £300 to £455 for claims between £5,000 and £10,000. Above that, it’s 5% of the claim, up to a maximum of £10,000. Hearings and enforcement each carry separate fees. You can check the current figures on GOV.UK.

In most cases the losing side pays a large part of the winner’s legal costs, but rarely all of them. On the small claims track you usually can’t recover legal fees at all, and for some claims up to £100,000 the costs you can recover are fixed in advance. Unreasonably refusing to mediate can also reduce what the court lets you recover.

Our fees are agreed before we start. We explain how we charge, court fees and what you might recover from the other side. If anything changes, we’ll explain why and agree it with you before extra work starts.

The defendant disputing every point can add time and expense, as can expert evidence or a full trial. That’s why we look for the most cost-effective route from the outset, including settlement. Our guide to making a breach of contract claim explains the early steps, but a consultation is the best way to get a realistic figure.

In your free consultation, we can:

  • Explain your legal position and the options open to you
  • Review any letters or court papers you’ve received
  • Talk through negotiation, mediation and court
  • Give you a realistic idea of costs before you commit

Can You Settle Without Going to Court?

Quite often, yes. Most disputes settle before trial, and the courts now expect you to try.

Since October 2024, judges can order the parties to try mediation or another form of alternative dispute resolution, and they can penalise anyone who unreasonably refuses. Most small money claims up to £10,000 now include a free one-hour mediation session as part of the court process.

Settling early saves money and stress, and it’s usually the only way to keep a business or neighbour relationship intact. But it only works if you negotiate from a position of strength, so we’ll make sure you understand your case before you sit down at the table. Our alternative dispute resolution solicitors can represent you in negotiation, mediation and arbitration.

Managing Complex and Urgent Situations

If You’ve Been Sent Court Papers

Don’t ignore them. You normally have 14 days from service of the claim to respond, either with a defence or an acknowledgement that gives you more time. If you miss the deadline, the other side can ask for judgment in default. Speak to us as soon as the papers arrive.

If Assets Might Disappear

If you think someone is moving or hiding money to avoid paying you, the court can step in quickly. We can apply for a freezing injunction to stop assets being dealt with, sometimes without the other side being told first. Read more about our fraud and asset recovery work.

If Someone Owes You Money

A statutory demand can put real pressure on a debtor. If a company owes you more than £750, or an individual owes you at least £5,000, an unpaid demand can lead to winding-up or bankruptcy proceedings. It isn’t suitable for disputed debts, so we advise on whether it’s the right step.

If Time Is Running Out

Most claims for breach of contract or negligence must be brought within six years, or 12 years for a deed. Employment claims are far shorter. For most events on or after 1 October 2026, you have six months less one day, and you must contact Acas first. If a deadline is close, call us straight away.

Questions about Litigation in Wimbledon

How much does a litigation solicitor cost?

It depends on the type of dispute, how much is at stake and how far it goes. A letter before claim costs far less than a case that goes to trial. We agree our fees with you before we start and give you a clear estimate at each stage. Court fees are separate and depend on the value of your claim.

Do I have to go to court?

Not usually. Most disputes settle through negotiation or mediation before trial, and the courts expect you to consider settlement. A hearing only becomes necessary if the other side won’t agree terms that reflect your legal position.

What is a letter before claim?

It’s a formal letter setting out your claim, the facts behind it and what you want. Court rules expect you to send one before starting proceedings and to give the other side a reasonable time to reply, usually 14 days or 30 days for most debt claims. Skipping it can lead to costs penalties, even if you win.

How long do I have to make a claim?

For most contract and negligence claims, six years. Claims based on a deed have 12 years. Some deadlines are much shorter, including most employment tribunal claims. If you think time may be running out, get advice straight away.

Can I get my legal costs back if I win?

Often, but rarely in full. The general rule is that the losing side pays a large part of the winner’s costs. On the small claims track you usually can’t recover legal fees, and many claims up to £100,000 have fixed recoverable costs. We explain what you could realistically recover at the start.

Can I have my consultation by video?

Yes. Our free 30-minute consultations take place by video, Monday to Friday. You speak to a senior solicitor from home or work, so there’s no need to travel to our Wimbledon office. To book, call 0203 983 5080, email [email protected] or fill in the form on this page.
